IMPORTANT: Nautix Capital is a capital advisory firm. We provide consultation and guidance to help businesses identify appropriate financing solutions.   • Credit Information: Personal credit score range (self-reported or obtained with consent), business credit profile, credit history.
  • Documentation: Business licenses, articles of incorporation, voided checks, lease agreements, and any other documents you provide in connection with your funding request.
  • Communication Preferences: SMS/text message consent status, email preferences.
  • Technical Data: IP address, browser type, device type, operating system, pages visited, referring URLs (collected automatically via cookies and similar technologies).

2. How We Use Your Information

We use your information for the following purposes:

  • Advisory Engagement: To process your inquiry and provide capital advisory services, including reviewing your information against criteria in our network of capital providers.
  • Introductions at Your Request: At your request, to introduce you to one or more capital providers in our network. Nautix Capital is an advisory firm and is not a lender; we do not originate, underwrite, approve, deny, or fund credit.
  • Customer Care Communication: To contact you regarding your inquiry, document requests, scheduling, and other advisory and customer-care matters.
  • SMS Messaging (separate, optional opt-in): To send administrative and customer-care SMS messages only — intake confirmation, scheduling/rescheduling, document requests, and updates that a provider meeting has been scheduled. No loan offers, quotes, approvals/denials, underwriting updates, rate/term discussions, or funding confirmations are sent via SMS.
  • Verification: To verify the accuracy of information provided and conduct fraud prevention measures.
  • Website Improvement: To analyze usage patterns and improve our website, services, and user experience.

3. Information Sharing

SMS opt-in data and consent are never shared with capital providers, affiliates, or any third parties for any purpose — and that is true regardless of any other information sharing described below. Capital providers cannot rely on Nautix consent to contact you by SMS; they may only do so under consent the consumer separately gives them.

BY SUBMITTING AN INQUIRY THROUGH NAUTIX CAPITAL, YOU EXPRESSLY AUTHORIZE US, AT YOUR REQUEST, TO FACILITATE INTRODUCTIONS TO CAPITAL PROVIDERS IN OUR NETWORK AS PART OF OUR ADVISORY ENGAGEMENT. NAUTIX CAPITAL IS NOT A LENDER AND DOES NOT MAKE LENDING DECISIONS.

Information shared with a capital provider when you ask us to introduce you may include:

  • All contact information
  • Business and financial information
  • Credit indicators and history
  • Any documentation you provide

Following an introduction, the capital provider may contact you directly via phone, email, or mail regarding the introduction or transaction at hand. Each capital provider operates under its own privacy policy and terms, which will govern their use of your information once shared. Nautix Capital is not responsible for the privacy practices of capital providers in our network.

4. Credit Inquiries

Submission of your information may result in one or more of our lending partners conducting credit inquiries. These inquiries may be "soft pulls" (which do not affect your credit score) or "hard pulls" (which may affect your credit score), depending on the product and lender. By submitting your application, you authorize Nautix Capital and our lending partners to obtain consumer and/or business credit reports as necessary to evaluate your financing request.

5. Telephone Consumer Protection Act (TCPA) Consent

By providing your phone number, you consent to receive phone calls from Nautix Capital regarding your inquiry, which may be made using an automatic telephone dialing system (autodialer) or prerecorded voice. SMS/text messages will be sent only by Nautix Capital and only if you have separately opted in to SMS communications. Capital providers in our network cannot rely on consent given to Nautix Capital to contact you by SMS; they may only do so under consent the consumer separately gives them. Nautix Capital is a capital advisory firm and does not make lending decisions; messages will not include loan approvals, funding confirmations, or other lending-process content. You understand that consent is not a condition of receiving services. Message and data rates may apply. You may opt out of SMS at any time by replying STOP to any text message or by contacting us directly.

6. SMS/Text Message Consent

SMS opt-in data and consent are never shared with capital providers, affiliates, or any third parties for any purpose (excluding aggregators and providers of the text-message services strictly to deliver the messages you have requested). Capital providers cannot rely on Nautix consent to contact you by SMS; they may only do so under consent the consumer separately gives them.

SMS consent is optional and is not required to receive our services. SMS consent is collected separately from email consent and is not bundled with any other communication channel. By checking the SMS consent box, you agree to the following: Nautix Capital uses SMS only for administrative and customer-care messages related to a user’s inquiry and engagement with our advisory team (intake confirmation, scheduling/rescheduling, document requests, and updates that a provider meeting has been scheduled). No loan offers, quotes, approvals/denials, underwriting updates, rate/term discussions, or funding confirmations are sent via SMS. Message frequency varies. Message and data rates may apply. You may reply STOP to opt out or HELP for assistance at any time.

7. Other Disclosures of Information

In addition to sharing with lending partners, we may disclose your information:

  • Service Providers: To service providers who assist in our operations (hosting, CRM, SMS delivery, payment processing) under strict data processing agreements.
  • Legal Compliance: To comply with any court order, law, or legal process, including responding to government or regulatory requests.
  • Protection of Rights: To enforce our Terms and Conditions and protect the rights, property, or safety of Nautix Capital, our clients, or others.
  • Business Transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets.

We do not sell your personal information for marketing purposes to unrelated parties.

8. Legal Basis for Processing (GDPR)

For users in the European Economic Area (EEA), UK, or Switzerland, we process your data based on:

  • Contract Performance: Processing necessary to respond to your funding inquiry and provide our services.
  • Consent: For SMS communications (you may withdraw consent at any time).
  • Legitimate Interests: To improve our services, prevent fraud, and — at your request — facilitate introductions to capital providers in our network as part of our advisory engagement.

9. Data Retention

  • Inquiry Data: Retained for 3 years from last interaction, or as required by law.
  • SMS Consent Records: Retained for 5 years to demonstrate compliance.
  • Technical Logs: Retained for 90 days.
  • Transaction Records: Retained for 7 years or as required by applicable law.

10. Your Rights

Depending on your location, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate information.
  • Deletion: Request deletion of your personal information (subject to legal retention requirements).

  • Right to Delete: You may request deletion of your personal information, subject to exceptions.
  • Non-Discrimination: We will not discriminate against you for exercising your rights.

12. Data Security

We implement industry-standard security measures including HTTPS encryption, access controls, and secure data storage to protect your information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security of your data.

13. International Data Transfers

Your information may be processed in the United States. If you are located outside the US, by submitting your information, you consent to its transfer to and processing in the United States, where data protection laws may differ from your jurisdiction.

14. Do Not Track

At present, there is no standard or agreement on how to respond to "do-not-track" signals that may be sent by web browsers. Accordingly, Nautix Capital currently does not take any action in response to these signals.
